These Terms and Conditions (“Terms”) govern your use of the Kifaru Discover Safaris website (kifarudiscoversafaris.com) (the “Website”) and our related services (the “Services”), which include booking Kenya Safaris, African Safaris, tours, hotels, flights, transportation, and transfers.

1. Booking and Payment

   • All bookings are subject to availability.
   • To confirm a booking, a non-refundable deposit is required, unless otherwise stated.
   • Full payment must be made before the commencement of the safari.
   • Payments can be made via credit card, bank transfer, PayPal, Payoneer, Mpesa, or any other method agreed upon by both parties.

2. Cancellation and Refunds

   • Cancellations made by the client are subject to the following refund policy:
     • Cancellations made [X days/months] prior to the safari will receive a full refund, minus any non-refundable deposits.
     • Cancellations made within [X days/months] of the safari are non-refundable.
   • Kifaru Discover Safaris reserves the right to cancel a safari due to unforeseen circumstances. In such cases, clients will receive a full refund or the option to reschedule.

3. Changes to Itinerary

   • Kifaru Discover Safaris reserves the right to alter itineraries due to weather conditions, wildlife movements, or any other circumstances beyond our control.
   • We will make every effort to provide a similar experience or offer alternative arrangements in such situations.

4. Travel Insurance

   • We strongly recommend that all clients purchase comprehensive travel insurance to cover any unforeseen circumstances, including trip cancellation, medical emergencies, and loss of personal belongings.

5. Health and Safety

   • Clients must inform us of any medical conditions, disabilities, or dietary requirements prior to booking.
   • Participation in safaris may require a certain level of physical fitness. Clients are responsible for assessing their own suitability for the chosen safari.

6. Liability

   • Kifaru Discover Safaris will not be liable for any loss, damage, injury, or expense resulting from circumstances beyond our control, including but not limited to natural disasters, acts of terrorism, or government restrictions.
   • Clients are responsible for their own personal belongings during the safari. Kifaru Discover Safaris will not be liable for any loss or damage to personal property.

7. Code of Conduct

   • Clients are expected to adhere to a code of conduct that respects local cultures, wildlife, and the environment.
   • Any behavior deemed to be disruptive, disrespectful, or dangerous may result in the termination of the safari without a refund.

8. Privacy Policy

   • Kifaru Discover Safaris respects the privacy of our clients and will not disclose any personal information to third parties without consent, except as required by law.
   • By using our services, clients consent to the collection and use of their personal information for the purpose of fulfilling bookings and providing a personalized safari experience. Read our privacy policy here.

9. Governing Law

   • These terms and conditions are governed by the laws of Kenya. Any disputes arising from or relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Kenya.
